Tort Reform Update: Housley Presumption Has Changed

Louisiana’s new tort reform laws are taking effect, and that means the “rules of engagement” in injury cases are changing. One of the most important shifts for everyday people is the change to the Housley presumption, a legal presumption that historically helped injured victims prove that an accident caused their medical problems.

Under the new law (applying to accidents that occurred on or after May 28, 2025), that presumption has been removed. Practically speaking, that can make medical causation more contested in many cases, especially when the insurance company argues a condition was “pre-existing” or unrelated to the crash.
