Multiple legal actions have followed the August 22, 2025, explosion at Smitty's Supply in Roseland, Louisiana. The company has sued its equipment suppliers, while residents and other groups have filed lawsuits against Smitty's.
Lawsuit filed by Smitty's Supply
In October 2025, Smitty's Supply filed a lawsuit against two companies, blaming them for the explosion. The lawsuit alleges that a faulty thermal fluid heater, or industrial boiler tank, was the cause of the fire and subsequent blast.
- Defendants: The suit was filed against Fulton Thermal Corp., which manufactured the tank, and J&M Boiler Combustion Control Services, which installed and maintained it.
- Counter-claim: An owner of J&M Boiler has pushed back on the claims, stating that the company had not worked with Smitty's for several years.
Lawsuits filed against Smitty's Supply
Smitty's is facing legal action from residents and environmental groups over damages caused by the explosion.
- Farmer's lawsuit: In September 2025, a lawsuit was filed by a nearby farmer who claimed property damage, livestock death, and contamination from the fire's toxic fallout. The suit alleges that Smitty's was negligent and had a long history of environmental violations.
- Basis for claims: Other lawsuits mention Smitty's history of environmental violations, including multiple Clean Water Act violations and fines from the Environmental Protection Agency (EPA) over the last several years.
EPA consent order
In October 2025, the EPA turned over control of the cleanup to Smitty's Supply, following the signing of a consent order.
- The consent order legally mandates Smitty's to take over responsibility for the ongoing cleanup and remediation of the site.
- Smitty's had previously withdrawn from cleanup efforts due to financial issues, prompting the EPA to take the lead.
- The EPA will continue to oversee Smitty's work to ensure cleanup requirements are met.
Ongoing investigation
While Smitty's has provided a potential cause for the incident in its lawsuit, the official investigation into the explosion's cause remains ongoing.
