As technology reshapes every industry, including law, a common question surfaces: Will AI replace attorneys? My answer is simple: AI is a powerful tool, but it is NOT a lawyer.
What AI can and cannot do
- AI can rapidly search information, draft preliminary documents, and summarize legal concepts.
- AI did not attend law school, did not pass the bar, and does not swear an oath or hold confidentiality, loyalty, competence, or accountability. These are essential protections you rely on in legal representation.
The limits and risks of AI in law
- AI can be wrong. It may generate information that looks plausible but is inaccurate, including fabricated cases, incorrect citations, or made-up facts.
- Courts are increasingly seeing pro se filings aided by AI, which can waste time, confuse issues, and potentially hurt the filer if the information is incorrect or inappropriately used.
- A federal judge recently warned about wasted time and confusion caused by nonexistent cases and false assertions in AI-assisted filings.
The difference between information and advice
- AI can provide general information about law, but it cannot tailor legal advice to your unique circumstances.
- Legal advice requires confidentiality, ethical obligations, and a human professional ready to advocate for you.
What you should do
